Terms and Conditions of the FYLKA Online Store

I. Definitions
The following terms used in these Terms and Conditions shall have the following meanings:
Customer – a natural person, legal entity, or organizational unit without legal personality but granted legal capacity under applicable laws, placing an Order through the Store.
Civil Code – the Polish Civil Code of 23 April 1964, as amended.
Terms and Conditions – these Terms and Conditions governing the provision of electronic services via the online store www.fylka.eu.
FYLKA Online Store – the online service available at www.fylka.eu through which Customers may, in particular, place Orders.
Goods – products presented in the Online Store.
Sales Agreement – a sales contract within the meaning of the Polish Civil Code concluded between Bird Baking – Agata Rządkiewicz and the Customer using the Online Store.
Consumer Rights Act – the Polish Consumer Rights Act of 30 May 2014, as amended.
Order – the Customer's declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
II. General Provisions
These Terms and Conditions specify the rules for using the online store available at www.fylka.eu.
The Online Store is operated by Bird Baking – Agata Rządkiewicz, ul. Ceglana 8, 87-100 Toruń, Poland, Tax ID (NIP): 9562369488, REGON: 389335325.
These Terms and Conditions define in particular:
a) the rules for registration and use of a customer account;
b) the terms and conditions for electronically reserving products available through the Online Store;
c) the terms and conditions for placing Orders electronically;
d) the rules for concluding Sales Agreements using the services provided by the Online Store.
Purchasing products does not require registration.
Information presented on the Store's website, including product descriptions, technical specifications, features, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
Orders are placed using the order form available on the Store's website.
Every Customer registering or placing an Order agrees to receive emails regarding the status of their transaction and notifications concerning amendments to these Terms and Conditions.
To ensure the security of transmitted communications and personal data, the Online Store applies technical and organizational measures appropriate to the level of risk, particularly measures preventing unauthorized access to or modification of personal data transmitted via the Internet.
III. Procedure for Concluding a Sales Agreement
To use the Store, the Customer must have Internet access, a properly functioning web browser (including on mobile devices), and an active email account.
To conclude a Sales Agreement, the Customer should visit www.fylka.eu, select products, and follow the instructions displayed on the website.
The Store accepts orders 24 hours a day, 7 days a week.
Products are added to the shopping cart to create an Order.
Until the "Place Order" button is clicked, the Customer may modify the selected products and entered information.
To complete an Order, the Customer must provide:
a) full name/company name;
b) delivery address;
c) email address;
d) contact phone number;
e) Tax Identification Number (VAT UE/NIP), where purchasing on behalf of a business.
Once all required information has been entered, an Order Summary will be displayed, including:
a) ordered products;
b) unit prices, total price, shipping costs, and any additional charges;
c) selected payment method;
d) selected delivery method.
Submitting an Order requires acceptance of these Terms and Conditions, providing mandatory personal data, and clicking the "Place Order" button.
Submitting an Order constitutes the Customer's declaration of intent to conclude a Sales Agreement with FYLKA (Bird Baking – Agata Rządkiewicz).
After the Order has been placed and paid for, the Customer will receive an email entitled "Order Confirmation," confirming all essential elements of the Order.
The Sales Agreement is concluded upon receipt of this confirmation email.
The Agreement is concluded in the Polish language and governed by these Terms and Conditions.
IV. Delivery
All prices are quoted in Polish zloty (PLN) and exchanged to local currency of the Customer, so prices may vary daily depending on the exchange rate and include VAT but exclude shipping costs.
Shipping costs are added to the total Order value and are borne by the Customer.
Free Shipping
Orders worth PLN 300 or more are shipped free of charge within Poland.
The binding price is the price displayed at the time the Order is placed.
Available Shipping Methods
We ship via the following carriers in Poland:
InPost Courier - PLN 18.
DPD Courier - PLN 15.
DHL Courier - PLN 15.
Shipping within the EU:
Courier - PLN 70.
The total Order value, including shipping costs, is displayed during checkout and in the Order Confirmation.
The Store delivers throughout Poland, European countries, and selected countries on other continents.
Orders are delivered by courier or to designated collection points.
For deliveries within Poland, orders are dispatched within 1-2 business days from receipt of payment.
Delivery times for international shipments are displayed during checkout depending on the destination country.
The Customer receives an order confirmation and specification together with the shipment, while the sales document (VAT invoice) is issued electronically.
B2B customers
Customers purchasing on behalf of a business may provide their VAT/NIP number and company details to receive a VAT invoice.
Invoices for Polish B2B customers are issued and recorded in the Polish National e-Invoicing System (KSeF). A PDF copy containing the KSeF QR code will be sent by email. Invoices for B2B customers from EU (apart of Poland) will be issued as electronic VAT invoices, including VAT amounts exchanged to PLN according to Polish law.
V. Payment Methods and Prices
All prices are expressed in Polish zloty (PLN) and include all applicable taxes.
Payments may be made:

via the Przelewy24 payment gateway using supported banks, payment cards, or other available payment methods;

by traditional bank transfer to the account number provided after placing the Order.
Some payment methods may occasionally be unavailable due to technical reasons on the payment provider's side.
If payment fails and the Customer still wishes to complete the purchase, they may contact the Store at fylka.eu@gmail.com to reactivate the payment.
If no payment or contact is received, the Order will be cancelled within 24 hours.
VI. Right of Withdrawal
Consumers have the statutory right to withdraw from a distance contract without providing any reason within 14 days.
The withdrawal statement may be submitted:

Upon withdrawal, the Agreement shall be deemed never to have been concluded.
Returned products must be sent within 14 days to the address above and should be adequately packed to prevent transport damage.
If the Customer withdraws from the entire Order, the Store will refund all payments received, including standard delivery costs (excluding any additional costs resulting from choosing a delivery method other than the least expensive option offered).
If only part of an Order is returned, delivery costs are not refunded.
Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.
The Customer bears the direct cost of returning the Goods.
The Store does not accept cash-on-delivery returns.
Returns via InPost Parcel Locker are possible only after prior agreement with the Store.
VII. Complaints
If a purchased product is non-conforming or defective, the Customer may submit a complaint under applicable Polish consumer protection laws.
Complaints should first be submitted by email to fylka.eu@gmail.com. The Store will then provide further instructions.
Products sent under complaint should be securely packed.
Depending on applicable law, the Customer may request:

repair;

replacement;
-
price reduction;
-
withdrawal from the contract.
The Store shall consider complaints within 14 days of receiving both the complaint and the complete product.
The Store reserves the right to reject complaints resulting from:
-
modifications made by the Customer;
-
mechanical damage caused by the Customer;
-
improper maintenance;
-
use contrary to the product instructions.
If the complaint is accepted, return shipping costs will be reimbursed within 14 days.
VIII. Personal Data Protection
Completion of an Order requires providing all mandatory personal data and accepting these Terms and Conditions.
Personal data are processed solely for purposes connected with the performance, amendment, or termination of the Sales Agreement and, where consent has been given, for marketing purposes.

Only the minimum data necessary for each purpose are shared.
Personal data may also be disclosed to public authorities where required by law.
Customers have the right to access, rectify, update, or delete their personal data.
With separate consent, personal data may also be used for promotional and marketing purposes.
Customers may subscribe to the Store's newsletter either during registration or directly on www.fylka.eu by providing an email address.
Newsletter subscriptions may be cancelled at any time via the unsubscribe link or by contacting the Store by email.
The Store uses cookies to improve functionality, usability, and navigation, as well as to analyze website traffic and product popularity.
Customers may disable cookies in their browser settings; however, some Store functions may then become unavailable.
IX. Final Provisions
All content published in the Store is protected by applicable intellectual property laws.
Any unauthorized use constitutes an infringement of applicable law.
Matters not governed by these Terms and Conditions shall be governed by the applicable laws of the Republic of Poland, including the Polish Civil Code, the Consumer Rights Act, and other generally applicable legal provisions.
